CONTROL OF CLOSED SCHOOL BUILDING | ||

You asked which town body has control over a closed, unoccupied school building and, if it is the board of education, how the building could be turned over to the town.
State law gives local boards of education charge of the schools in its school district and responsibility for the "care, maintenance, and operation of buildings, lands, apparatus, and other property used for school purposes" (CGS § 10-220(a)). But once a building is no longer used for school purposes, the board of education is no longer responsible and control reverts to the town. The board can formally turn over control of a closed school building to the town by voting to relinquish control to it (Thomas B. Mooney, A Practical Guide to Connecticut School Law, 2d. Edition, p. 103).
