By: Jennifer Gelb, Research Attorney | ||
You asked (1) how many criminal history background checks were carried out last year for each category of applicants, (2) if additional statutes requiring these checks need to be updated, and (3) if there are checks required by regulation that are not reflected in the statutes.

The State Police Bureau of Identification keeps monthly records of the number of applicant fingerprints it receives to carry out criminal history records checks on applicants in each of 23 possible categories.

There are four statutes that still need to be updated to reflect the changes in criminal history background checks as a result of PA 01-175. We have enclosed a copy of the public act summary for PA 01-175 for your reference. The statutes in need of update are:
1. § 6-32g. Criminal record background investigation of applicants for employment as judicial marshal after December 1, 2000.
2. § 13b-97. Certificate of public convenience and necessity.
3. § 29-33. Sale, delivery or transfer of pistols and revolvers.
4. § 29-37F. Qualifications of retail store employees who sell firearms.
CHECKS REQUIRED BY REGULATION
There are seven criminal history background checks required by regulation that were not incorporated into PA 01-175. These are:
1. § 7-294e-16. Entry-level requirements (to be a police officer).
2. § 12-574-E5. Occupational license - class III license applicant (non-management related).
3. § 13b-17-128a. Required components (for petitions and applications to Department of Transportation).
4. § 17a-20-22. Personnel policies and procedures (for employees and volunteers at outpatient children's psychiatric facility).
5. § 17a-147-11d. Personnel policies and procedures (for employees and volunteers at children's extended-day programs).
6. § 53-202d-2. Application for certificate of possession (of a weapon).
7. § 54-125a-3. Procedure for parole eligibility.
