CONNECTICUT LAWS INVOLVING MARITAL STATUS

You asked about Connecticut statutes that refer to marital status.

SUMMARY

We conducted a computer search of the Connecticut General Statutes using keywords and word stems associated with marital status (such as "spouse," "widow," "next of kin," and "marr!"). After eliminating repealed laws and those not relevant to your request (such as laws regulating family and marital therapists), we identified 588 laws codified in the 2001 General Statutes in which marital status is a factor. We grouped the results into the following subject-matter categories:

We describe below limitations on the methodology and summarize the types of laws included in each category. We also provide tables listing the statutes our search identified by category. (Where a law could be listed in several categories, we selected the one we thought was most directly relevant.) The laws are arranged within each table in the order that they appear in the General Statutes, identified by title, chapter, number, and "catchline" assigned by the Revisors of the General Statutes.

LIMITATIONS ON METHOD

The electronic search and classification technique we used mirrors what the U.S. General Accounting Office (GAO) did in 1997 to identify 1,049 laws in the United States Code in which marital status is a factor (GAO/OGC Report No. 97-16). GAO acknowledged limitations on the reliability of this methodology, such as its inability to identify statutes that incorporate marital status by using a neutral term (such as "relative") that is defined elsewhere as including spouses. Nevertheless, the agency concluded that its electronic search was highly likely to have identified all federal programs in which marital status was a factor, and that while reading and analyzing the entire U.S. Code would produce a longer list of laws, it would not generate substantially more useful information.

We agree with the GAO's conclusion that this methodology, while not perfect, gives as complete an overview of state programs in which marital status plays some role as we can produce without reading and analyzing all 55 titles of the Connecticut General Statutes. Thus, our tables show when marital status bears some relationship to a statutory program, but do not always include all individual laws within it in which this status is relevant. They also have not captured instances where a program applies to "families" or "relatives," for example, but leaves it to executive branch agencies or others to determine whether those terms include spouses.

Also as the GAO noted, compiling a list of laws that have some relationship to marital status may not, in and of itself, produce a meaningful result. Some of the laws identified favor married people, some disadvantage them, and some do both. Others apply equally to single and married people, while others simply proscribe procedures for maintaining marriage records.

MARRIAGE, DIVORCE, AND SUPPORT

This category includes laws governing the formation and validity of marriages and many of the financial and legal obligations imposed by law on married people. It includes provisions designating court proceedings involving such arrangements as family relations matters and specifying special procedures and court services associated with them.

It also includes grounds for separation, divorce, and annulment and legal and equitable considerations governing the division of marital property, alimony, child support, and custody obligations. These include provisions permitting family court judges to issue orders while a divorce action is pending to preserve assets, establish interim financial support obligations, and set temporary child custody and visitation schedules. They also include uniform child custody jurisdiction and support rules that make it easier to enforce and modify court orders across state lines.

LEGAL NOTICE AND AUTHORITY TO ACT IN MATTERS AFFECTING FAMILY MEMBERS

The largest number of laws in this category involve the rights of spouses to gain access to otherwise confidential information and to make decisions affecting another person's health and well-being. These include rights of access to medical information, to private visits in hospitals and nursing homes, and to make decisions in medical emergencies or when a spouse is unable to express his wishes. In some cases, these laws give spouses decision-making rights superior to those of blood relatives. Some laws specify when divorce presumptively makes inoperative certain legal designations, such as health care agent appointments.

This category also includes laws directing courts and state agencies to give spouses notice of court proceedings involving certain mentally ill, retarded, or incapacitated people and to notify them when a person under a voluntary commitment leaves a hospital or substance abuse treatment facility.

It also includes court rules and civil claims that married people can bring when third parties harm their partners. For example, it includes the privilege of spouses to refuse to testify about their private communications in criminal and civil matters. It also includes the rights of spouses to sue people responsible for their partner's death and recover compensation when a spouse's injuries interfere with their own rights of comfort, companionship, and support (known as "loss of consortium"). Spouses of crime victims are also eligible in some cases for crime victim compensation and victim services. They are permitted to attend and express their views at various court and administrative proceedings related to the crime.

Several laws that bar spouses from seeking compensation for losses caused by the other spouse's misconduct are also included in this category. For example, husbands and wives of people engaged in insurance-related occupations cannot file such claims with the Insurance Department's Brokered Transactions Guaranty Fund; a similar bar applies to real estate brokers' spouses.

Finally, this category includes laws relating to spousal consent for adoptions and provisions giving spouses authority to act on behalf of their minor step-children in some situations.

Many of the laws included in this category give special status to spouses of property-owners and license-, permit-, and franchise-holders. For example, several environmental protection laws exempt private landowners and their spouses from certain hunting and fishing license requirements, and another exempts surviving spouses of commercial fishing license holders from a moratorium on the issuance of new licenses. Another law prevents a married couple from having more than four liquor permits by counting both the applicant and spouse's holdings. Other laws exempt from regulatory requirements certain financial and securities transactions involving spouses.

Another sizeable group of laws in this category permit entities with restricted membership rules (e.g., credit unions, HMOs, and private clubs) to offer benefits or services to their members' spouses. Finally, others afford a tenant's spouse protections against such events as eviction, forced relocation, or utility service disconnection under certain circumstances.

BENEFITS OF GOVERNMENT OFFICIALS AND EMPLOYEES, VETERANS, AND MILITARY PERSONNEL

This category includes laws relating to current and retired state constitutional officers and legislators; state, town, and public school employees; veterans; and military personnel. These laws generally specify the various health, leave, retirement, survivor, burial, and insurance benefits the state and local governments provide to such people and their spouses. The provisions relating to veterans also include provisions permitting surviving spouses to keep special-issue veterans' motor vehicle plates and giving veterans' spouses extra points on classified service examinations under some circumstances. Those relating to military personnel include special benefits for dependents, including spouses.
