AN ACT CONCERNING THE LICENSING OF MENTAL HEALTH FACILITIES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Subsection (g) of section 19a-490 of the general statutes is repealed and the following is substituted in lieu thereof:

(g) "Mental health facility" means any facility for the care or treatment of mentally ill or emotionally disturbed adults, [except that on and after October 1, 1993, mental health facilities shall] or any mental health outpatient treatment facility that provides treatment to persons sixteen years of age or older who are receiving services from the Department of Mental Health and Addiction Services, but does not include family care homes for the mentally ill.

Sec. 2. Subsection (c) of section 19a-498 of the general statutes is repealed and the following is substituted in lieu thereof:

(c) The Department of Mental Health and Addiction Services, with respect to any mental health facility, as defined in subsection [(h)] (g) of section 19a-490, as amended by this act, or alcohol or drug treatment facility, as defined in subsection [(i)] (h) of section 19a-490, shall be authorized, either upon the request of the Commissioner of Public Health or at such other times as they deem necessary, to enter such facility for the purpose of inspecting programs conducted therein. A written report of the findings of any such inspection shall be forwarded to the Commissioner of Public Health and a copy shall be maintained in the facility's licensure file.
